Bankruptcy Courts in the United States

The federal court system of the United States has been broken up into 3 levels: the district level, the appellate division, and the Supreme Court. Each state has been given a minimum of one federal district court. This results in 94 separate federal districts in the United States. The bankruptcy courts correspond with the federal district courts.

Of the 94 separate judicial districts, all of the courts handle bankruptcy matters. In almost all of the districts, bankruptcy cases are filed in a bankruptcy court, rather than in the “normal” federal court. Bankruptcy petitions cannot be filed with the state courts.

Massachusetts has been divided into three federal districts. These districts are the eastern, central, and western districts. Each of these federal districts has a bankruptcy court that hears bankruptcy cases that are filed within the district.

The country was divided into districts by an act of Congress. Congress was given the power to create a court system as it saw fit by virtue of Article III of the United States Constitution. The federal courts are courts of limited jurisdiction that are able to hear cases only as Congress has given them the power to do so. Bankruptcy courts are typically only able to hear bankruptcy cases as they are cases of extremely limited jurisdiction.
